(a) Elke persoon (insluitend ‘n instelling of maatskappy, ens) wat binne die streek ‘n onderneming bedryf.

(b) Elke werkgewer wat ‘n werknemer (behalwe ‘n BONA FIDE private of huisbediende) binne die streek in diens het.

GENERAL INFORMATION
A    DECLARATION FOR REGISTRATION
A declaration for registration must be furnished by:

(a) Every persone ( including an institution or company,
etc.) who carries on an enterprise within the region;

(b) Every employer who employs a person (except any BONA FIDE private or domestic servant) within the region.

i)    ‘n Onderneming beteken enige beroep, besigheid, professie of ander bedrywigheid van ‘n voortdurende aard, ongeag of dit vir winsbejag beoefen word, al dan nie. ‘n Onderneming sal derhalwe ook insluit, bv, staats-departemente, maatskappye, korporasies en instellings sonder winsmotiewe, ens.

ii)    Godsdienstige en liefdadigheids-instellings wat aanspraak maak op vrystelling moet, tesame met die RSC 1 Verklaring (volledig ingevul), ‘n gemotiveerde aansoek om vrystelling indien asook ‘n volledige afskrif van hul akte van oprigting, konstitusie of ander stigtingsdokument. Alle opvoedkundige instellings is nogtans verplig on die RSC 1 Verklaring in te vul vir betaling van streeksdiensteheffings.

PLEASE NOTE

i)    An enterprise means any trade, business, profession or any other activity of a continuing nature, whether or not carried on for the purpose of deriving profit. An enterprise will therefore include, for example – goverment deparments, companies, corporations and institutions without profit motives etc.

ii)    Religious or charitable institutions which claim entitlement to exemption from the regional services council levies should submit together with the RSC 1 Declaration (duly completed), a motivated application, for exemption together with a copy of their deed of formation, constitution or other founding document. All educational institutions are nevertheless required to complete the RSC 1 Declaration for the purpose of paying the regional services levies.

B    PERSOON VERANTWOORDELIK VIR DIE RSC I VERKLARING

In die geval van –

a)    ‘n eenmansaak – die eienaar

b)    ‘n vennootskap – ‘n vennoot

c)    ‘n maatskappy – ‘n direkteur

d)    ‘n beslote korporasie – ‘n lid

e)    ‘n maatskappy in likwidasie of wat onder geregtelike bestuur geplaas is – enige likwadeur of geregtilike bestuurder

f)    ‘n liggaam van persone, hetsy deur enige statuut van die Republiek van Suid-Afrika gestig of nie (waarby ingesluit is staatsdepartemente, provinsiale adminstrasies, plaaslike owerhede, skole, instellings, ens, - enige bestuurder, beampte of ander verantwoordelike persoon binne sodanige instanie.

g)    ‘n handelsbevoegde persoon – die voog, kurator, administrateur of enige ander persoon beklee met aanspreeklikheid vir die bestuur of beheer vandie sake van die handelingsongebevoegde persoon.

h)    ‘n insolvente/bestorwe boedel, ‘n trust, ‘n bystands pensioen, voorsorg of uittredingsannuiteitsfonds of enige ander fonds- ‘n trustee, eksekuteur, administrateur of enige persoon wat in ‘n fidusiëre hoedanigheid optree.

B    PERSON RESPONSIBLE FOR THE RSC 1 DECLARATION

In the case of –

a)    a sole proprieor – the proprietor

b)    partnership – a partner

c)    a company – a director

d)    a close corporation – a member

e)    a company in liquidation or under judicial management – any liquidator or judicial manager

f)    a body corporate, whether constituted by any stature of the Republic of South Africa or not (including state departements, provincial administrators, local authorities, schools, institutions, etc.) – any manager, officer or any other responsible person in such organisation

g)    a person under legal disability – the guardian, curator, administrator, or any other person vested with the right of management or control of the affairs of the person underl legal disability.

h)    a insolvent/deceased estate, a trust, a benefi/pension/povident/ retirement annuity fund or any other fund – a trustee, executor, administrator or any other person acting on its behalf in a fiduciary capacity

C    TAKKE EN HANDELSNAME

Waar ‘n persoon verskeie ondernemings onder ander handelsname of een onderneming deur middel van verskeie takke in dieselfde Streeksdiensteraad se gebied bedryf, mag so ‘n persoon elke onderneming of tak daarvan afsonderlik op ‘n afsonderlike Verklaring vir Registrasie registreer. Sou die afsonderlike registrasie van elke onderneming of tak daarvan nie wenslik wees nie, moet sodanige pesoon elke onderneming of tak daarvan onder een Verklaring vir Registrasie registreer.

C    BRANCHES AND TRADE NAMES

Where a person carries various enterprises under different trade names or one enterprise through separate branches in the same Regional Services Council region, such person may register each enterprise or branch thereof separately using a seperate Declaration for Registration for each enterprise, or branch thereof. If seperate registration by the peron in respect of each entetprise or branch thereof is not desirable, the person concerned is then required to include each such enterprise or branch thereof under one Declaration for Registration.

D    REGISTRASIE

Kennisgewing van registrasie met voorskrifte vir die betaling van heffings sal mettertyd uitgereik word.
